What documents are needed to file a divorce petition in Delhi?

These documents will be necessary: Marriage Certificate / Marriage Registration Certificate, proof of identity, photos, income proof, proof of residence of both individuals, and every document proof that you may need to provide reasons to file for divorce, such as medical report, chat transcript, FIR, and witness testimonies.

A mutual divorce case typically takes around 6-18 months in India. This duration may increase depending on court procedures, hearing dates, and the complexity of the case. The duration of a contested divorce case may range between 1-3 years or more, depending on the number of disputes involved (grounds, custody, maintenance, property), the grounds being raised, the number of court hearings held, and appeal proceedings.

Women can seek divorce on special grounds of the husband’s bigamous marriage and guilt of sexual offences, like rape, sodomy, or bestiality, and if the court granted maintenance, but no cohabitation was resumed for 1 year. The wife can divorce on the option of puberty when married before the age of 15 years, where she can give up the marriage before attaining 18 years.  

If your husband deliberately skips court appearances, the court can pass an ex parte order to grant you a divorce in his absence, after giving sufficient chances.
